1. Introduction

HISTORA is a Software as a Service (SaaS) provided by Gemedata, Inc. (hereinafter, “Gemedata”), with EIN 36-5132321 and registered office at 2646 South Governors Ave #26461, Dover, DE 19904, United States. This platform serves as a database of dental clinical records, allowing patients of dental clinics to access their dental medical data and share it with professionals from different clinics, even abroad.

These Terms and Conditions (hereinafter, the “T&Cs”) govern the use of HISTORA by the Patient (hereinafter, the “Patient”). By using HISTORA, the Patient acknowledges having read and accepted these T&Cs in their entirety. If the Patient does not agree with any part of these T&Cs, they must refrain from using the platform.

Important Notice

HISTORA IS NOT A MEDICAL DEVICE OR PRODUCT.

HISTORA is a software tool designed exclusively for the management, storage, and communication of dental health information. It does not make diagnoses, offer treatments, prescribe medications, or in any way replace the clinical judgment, experience, or intervention of a qualified healthcare professional. Any decisions related to your health should be made in direct consultation with your healthcare professional.

2. Definitions

For greater clarity in these T&Cs, the following terms are defined:

  • Patient Content: This refers to all information, data, text, documents, images (including photographs and X-rays), 3D models, test results, and any other material that the Patient, or a Professional authorized by the Patient, uploads, submits, stores, or transmits through the Platform. This explicitly and completely includes all the content of their digital medical record.
  • HISTORA or Platform: This refers to the Software as a Service (SaaS) owned by Gemedata, accessible through web and mobile applications, which includes all its functionalities, databases, code, interfaces and associated technologies.
  • Digital Clinical Record (DCR): This refers to the compilation of your personal and dental health information stored on the Platform, which forms part of the patient’s content. The DCR belongs to the Patient.
  • Patient: Natural person who uses HISTORA to access their dental medical information and share it with professionals.
  • Professional: Dentist or other dental health professional who uses HISTORA to consult or add data to the Patient record.
  • Dental clinic: Entity that subscribes to the HISTORA service for its professionals and patients.
  • Personal data: Any information about an identified or identifiable natural person, including dental medical data and Patient contact information.
  • Artificial intelligence: This refers to the artificial intelligence functionality integrated into the Platform, based on third-party AI solutions. Its purpose is strictly non-diagnostic support, such as content organization and the provision of administrative or general guidance information.

3. Acceptance

By registering or being registered on HISTORA, the Patient declares that they have the legal capacity to accept these Terms and Conditions. Use of the platform is recommended for patients over the age of 18. If you are under 18, you will need the consent of your parent or legal guardian. Before using HISTORA, the Patient must confirm that they have read and agree to these Terms and Conditions. If you do not agree to these Terms and Conditions or the Privacy Policy, you will not be able to use HISTORA’s services.

Gemedata may modify these Terms and Conditions in the future for legal, technical, or operational reasons. In the event of significant changes, you will be notified through the platform or by registered email. If you continue to use the platform after notification of changes, you will be deemed to have accepted the new terms.

4. Service Description

HISTORA is a technology platform designed to provide greater centralized control over a patient’s dental medical history. The core service consists of offering a secure, cloud-based software infrastructure for the following purposes:

  • Store, organize and access your Digital Clinical Record (DCR) in a unified manner.
  • Grant and revoke, at your sole discretion, access to your Electronic Health Record (EHR) to one or more healthcare professionals.
  • Share specific information, such as photographs or documents, with your authorized Professionals.
  • Use the AI assistance tool for organizational and administrative support purposes.

Gemedata acts solely as a neutral technology intermediary. Our role is limited to providing the software infrastructure that enables interaction between the patient and their healthcare professionals. Gemedata does not practice dentistry, medicine, or any other health profession; does not endorse, recommend, or guarantee the quality of any professional; and is not part of the patient-professional relationship.

5. Patient registration and account

There are two ways to register an account as a patient: direct registration on the Platform, or invitation by your healthcare professional. Regardless of the registration method, account activation and use are conditional upon your explicit acceptance of these T&Cs. The Patient agrees to provide true, accurate, current, and complete information during the registration process. Providing false or inaccurate information may result in the suspension or cancellation of your account.

To access the Patient account, a unique identifier will be provided. It is the Patient’s responsibility to maintain the confidentiality of their credentials. If an unauthorized person has accessed the Patient’s account, the Patient must immediately notify Gemedata.

6. Use of artificial intelligence

The Platform includes AI functionality with a strictly limited, non-clinical purpose: organize and classify information within your RCD; provide general guidance on using the platform.

Prohibition of Clinical Use of AI

It is strictly prohibited to use AI assistance for self-diagnosis, treatment decisions, interpreting symptoms or clinical outcomes, or as a substitute for consultation with a qualified professional.

AI is not a doctor or dentist. The information it generates may be incomplete, inaccurate, or not applicable to your specific situation.

This AI functionality is powered by advanced third-party language models, such as Google’s Gemini. Gemedata will not be liable for any damages arising from the Patient’s reliance on information generated by this functionality.

7. Patient Content and Data

The Patient is the rightful owner of their medical and dental record data stored in HISTORA. The platform is designed to give you control over who can see your data or RCD. You may revoke access at any time. You have the right to request correction of inaccurate information and deletion of your account at any time.

8. Patient Obligations

By using the Services, the Patient agrees to comply with all applicable laws and regulations. The Patient agrees not to: use the services for any illegal purpose; upload material containing viruses; attempt unauthorized access to other accounts; reverse engineer the Platform; damage Gemedata’s servers; upload defamatory or obscene content; infringe intellectual property rights.

9. Disclaimer of warranties and limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICES AND PLATFORM ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND. GEMEDATA EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

Gemedata is not responsible for: the acts, diagnoses or treatments of any Professional; the accuracy of any Patient content; any dispute between the Patient and their Professionals; any unauthorized access not attributable to Gemedata’s gross negligence.

10. Data protection

Gemedata acts as the data processor on behalf of the clinics that use our HISTORA system, in accordance with Regulation (EU) 2016/679 (GDPR). For more information about your personal data, please contact the dental clinic that processes your personal data through HISTORA.

11. Suspension and termination of the account

The Patient may stop using Historia at any time. Gemedata reserves the right to suspend or deactivate the Patient account in cases of non-compliance with these Terms. If the Patient does not access their account for 12 months, Gemedata may mark it as “inactive” and proceed to delete it.

12. Intellectual Property

Gemedata is the exclusive owner of all rights to the HISTORA Platform. This Agreement does not transfer any ownership rights to the Patient, but only a limited and revocable right of use.
