This legal notice (the "Legal Notice") governs access to and browsing of the website https://www.histora.com (the "Website").

The Website is operated by Gemedata, Inc. ("Gemedata" or "We").

This Legal Notice is binding on any person accessing the Website (the "user" or "you"). Please note that by browsing the Website you declare that you have read and agree to be bound by the following documents: this Legal Notice, our Privacy Policy, and our Cookie Policy. If you do not agree with any of these documents, you should not access or use the Website.

If you wish to purchase our products and services through the Website, access to and use of the Historia platform is also governed by its own Terms and Conditions of Use, which must be explicitly accepted during the registration process on that platform.

The original version of this Legal Notice was written in Spanish. However, as a courtesy, we may provide users with versions of this Legal Notice in other languages ​​(for example, English). In the event of any discrepancy between versions, the Spanish version shall prevail.

1. Conditions of Access and Use of the Website

Access to and use of the Website is intended for individuals over eighteen (18) years of age. For use of the Histora platform, being of legal age is recommended. Minors will require the consent of their parent or legal guardian to register and use the platform, in accordance with the Histora Terms and Conditions of Use.

2. Description of the Website and the Historical Platform

The Website offers information about Gemedata products and provides access to our software as a service (SaaS) solution called 'Historia'.

Historia is a technology platform designed for the management, storage, and communication of dental health information. Its purpose is to allow patients to access their dental records, centralize them, and securely share them with the healthcare professionals of their choice.

3. Historical Record

Access to and use of the Website does not require the creation of a user account. However, to use the Historia platform services, it is necessary to create a patient account.

Registration can be done directly by the patient on the platform or by a professional at their dental clinic who has invited them. In both cases, use of Historia is conditional upon explicit acceptance of the specific Terms and Conditions of Use for patients.

The user declares to be responsible for reading and verifying the prior information and contractual documentation that we send during the hiring process.

4. Service Cancellation

As a user of the Historia platform, you can stop using the service and request the permanent closure of your account at any time through the options available on the platform itself. Account deletion will be processed in accordance with the Terms and Conditions of Use and the Privacy Policy.

5. Intellectual and Industrial Property

We own the intellectual and industrial property rights to the Website and all its related elements. This includes, by way of example:

  • All rights to the source code, object code, interface, databases and other elements of the Website.
  • All content on the Website (images, texts, videos, etc.).
  • All rights to our trademarks, trade names and other distinctive signs.

Users are not authorized to reproduce, distribute, publicly communicate or transform the Website or its contents.

For example, the above means that users cannot extract or reuse, in whole or in part, the information available on the Website, regardless of whether the extraction is done by automated techniques (screen-scraping, bots, spiders, etc.) or manually.

13. Applicable Law and Jurisdiction

This Legal Notice and access to and use of the Website are governed by Spanish law.

If you qualify as a consumer or user under applicable law, we will submit any dispute relating to this Legal Notice and access to and use of the Website to the exclusive jurisdiction of the courts of your place of residence or domicile, where required by law. In all other cases, to the extent permitted by law, you and we, expressly waiving our own jurisdiction, agree to submit to the courts of the city of Madrid.
